1. Definitions

Legislation on the Processing of Personal Data is taken to mean (i) EU Data Protection Directive (Directive 95/46/EC) of 25 October 1995 or any other implementing or related national legislation, (ii) EU Privacy and Electronic Communications Directive (Directive 2002/58/EC) of 12 July 2002 or any implementing or related national legislation, (iii) Commission Regulation (EU) 611/2013 of 24 June 2013 on the measures applicable to the notification of personal data breaches under Privacy and Electronic Communications Directive 2002/58/EC of the European Parliament and of the Council, (iv) Commission Regulation (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and the free movement of such data, and repealing Directive 95/46/EC as of 25 May 2018, and (vi) any other applicable legislation, present or future, with regard to or having an impact on privacy and the processing of personal data.

2.1. The protection of your privacy and personal data is one of Our top priorities. This Privacy Policy describes how we process your personal data on Our website www.recupel.be and for the purposes of direct marketing.

2.2. Recupel VZW (“We” or “Us”, or “Our”) is a Belgian company with its registered office at 1030 Schaerbeek, Boulevard Auguste Reyerslaan 80   and registered with the Crossroads Bank for Enterprises under the number 0473.923.093. Our contact details are published on Our website www.recupel.be.

2.3. We fit the definition of ‘quality controller’ as included in the Legislation on the Processing of Personal Data, as regards the processing of your personal data for the purposes stated in this Privacy Policy.   

3. Personal data

The following personal data will be processed:
Your contact information (name, address, e-mail address, telephone number, etc.)  .

4. Purposes of the processing

4.1. Your personal data will be processed for the following purposes:

• To answer questions you have submitted via the online contact form, chat or e-mail;
• Sending information on Our services.
  The purposes of the processing of personal data through cookies are described later in this Privacy and Cookie Policy.
• Participation in a competition organised by Us (more information at point 12).

4.2. We will process your personal data only for the purposes for which they are collected. You will be informed in advance if We intend to process your personal data for purposes other than those listed in this Privacy Policy.

5. Legal grounds

You will be asked to consent to the legitimate processing of your personal data for the above-mentioned purposes. Ticking the box “I AGREE” or any similar solution that is implemented implies your acceptance. You have the right at all times to withdraw your consent. This withdrawal will not affect the lawfulness of any processing of personal data carried out before your consent was withdrawn.

6. Receivers of personal data

6.1. We are entitled to share your personal data with Our affiliated companies, suppliers and partners solely for the purposes listed under article 4 of this Privacy Policy, etc.

6.2. We are entitled to share your personal data with third parties who perform services for Us, including but not limited to IT service providers.

6.3. We are also entitled to share your personal data with third parties if required by law or court order. .

6.4. In case of a partial or complete reorganisation of Our company we are also entitled to share your personal data with (non-)affiliated third parties.

7. Transmission of personal data

We will only process your Personal Data within the European Economic Area.

8. Retention period

Your personal data will be stored (i) as long as you or your business continue to use Our services, (ii) as long as necessary to fulfil the above-mentioned purposes, or (iii) as long as storage of your personal data is required by law. In any case your personal data will be removed two (2) years after the expiry of the above-mentioned periods.

9. Your rights

9.1. In accordance with the stipulations of the Legislation on the Processing of Personal Data you have the right (a) to obtain access to, rectify or erase your personal data, (b) to obtain restriction of the processing of your personal data or object to the processing of your personal data, (c) to obtain your personal data in a structured, common and machine-readable format and (d) to lodge a complaint with the supervisory authority (The Data Protection Authority, www.dataprotectionauthority.be).

9.2. The rights listed above can be exercised by using our contact form or via a similar technical solution that is implemented on the website.  

10. Modifications to this privacy policy

We reserve the right to adjust this Privacy Policy at any given time. All modifications to this Privacy Policy will be announced and you will be asked for your consent pursuant to the stipulations of article 5.1 of this Privacy Policy if said modifications alter the purpose of the processing.

11. Chatbot

Recupel is not liable for damages resulting from incomplete or incorrect information distributed by the Chatbot. If you wish to obtain certainty about your questions, please contact Recupel through the contact form.

12. Contests

Recupel organises contests on a regular basis in which natural persons can participate.

To make participation in these competitions and their organization possible, Recupel processes certain personal data. The following personal data may be processed in this context:

• First and last name
• E-mail address
• Language
• Telephone number
• Mailing address
• Visual material (photographs, videos)
• Information about the employer

This data will only be processed to register natural persons as participants, to communicate about their participation in the competition, to communicate about the winner(s) of the competition and possibly to deliver the prizes to the winner(s).

If there is a public communication of the results of the competition, explicit consent will be requested from the participant(’s) at the time of entry into the competition.

The personal data that Recupel receives in the context of this competition will be deleted after the competition has ended and the prizes have been distributed, or at the latest 3 months after the end of the competition and the distribution of the prizes.

The participant's rights may be applied in accordance with point 9 of this privacy policy. However, it is possible that the competition rules specify an additional (email) address in order to exercise these rights.

Any participant who requests the deletion of his/her data during the course of the competition accepts that his/her participation is automatically terminated as a result.
